Kiption Cloud

Terms of service

Kiption Cloud is a managed hosting service for fiction archives, run by Hyperion360 Inc. (doing business as Kiption) (https://hyperion360.com/). We run the servers, keep the software current, take automatic backups, and keep each archive reachable at its own address. Subscribing means you accept these terms.

Each archive has one owner account: the person who signed up, who sets the archive's policy, and who answers our mail. The owner is our point of contact for the archive and is responsible for keeping the account's login safe.

Your archive's content belongs to you, and responsibility for it rests with you, the archive owner, not with us. We do not review, endorse, or curate your stories; we keep the archive running. Stay within the acceptable use policy and the law.

You pay the plan price shown at signup, monthly or annually as you choose. The price is per archive, never per reader: readers are never billed, never shown ads, and never shown a paywall. The subscription renews until you cancel it.

Either side can end the service. You can cancel any time from the billing link we email you; we can end a subscription for nonpayment or for a break of the acceptable use policy. A failed payment does not suspend the archive at once: it keeps serving through a 7-day grace period, so updating the card fixes it. When a subscription ends, the archive is suspended and its data is kept for 30 days so you can export everything; after those 30 days the data is deleted.

Disputes follow a short ladder, and every step is cheap on purpose. Talk first: either side describes the problem in writing, and email to help [at] kiption [dot] com is writing; both sides try in good faith for 30 days to resolve it. If talking does not resolve it, either side may propose a single session with a mediator, held remotely, with the fee split evenly; mediation is not binding and does not delay either side's rights. Either side may take any dispute that fits a small-claims court's limits to that court instead, including the small-claims court near where you live. Everything else is brought in the state and federal courts in Delaware, and these terms are governed by Delaware law. Disputes are individual: where the law allows, a class, consolidated, or representative proceeding is waived, and if that waiver fails the dispute still proceeds individually; a jury trial is waived where the law allows; and any claim must be filed within one year after it arises or it is barred.

These terms can change; material changes are announced on the status page before they take effect.

You retain all rights to works you post and grant this service only the license it needs to host and display them; no license is granted for machine-learning training. Uploading material you do not hold rights to, including commercial exploitation of fan works through payment links or paywalls, is a violation of these terms; repeated violations terminate the account under the published repeat-infringer policy.
